Congresswoman Nancy Mace Introduces the Sue VOYEURS Act

(Washington, D.C. April 16th, 2024) - Today, Congresswoman Nancy Mace (R-SC) announced the introduction of the Sue Victimizers and Offenders who Yield Explicit Unconsented Recordings Surreptitiously Act, also known as the Sue VOYEURS Act. This legislation aims to allow victims of video voyeurism to sue their offenders and prevent the unauthorized capture and sharing of intimate images and videos.

"Voyeurism violates people's privacy and dignity, and causes unimaginable trauma. This legislation is going to do something about that," said Congresswoman Mace. "No one should be filmed while in vulnerable or intimate moments without their knowledge or consent. Victims of video and photo voyeurism should have the ability to seek justice and hold perpetrators accountable for their repulsive behavior."

Key provisions of the Sue VOYEURS Act include establishing a civil action for individuals whose intimate visual depictions are captured without consent in circumstances where there is a reasonable expectation of privacy, specifying that individuals can bring a civil action against the person who captured the intimate visual depiction, allowing recovery of actual damages or liquidated damages of $150,000 for each intimate visual depiction captured, along with the cost of the action, including attorney's fees and other litigation costs, granting the court authority to order equitable relief, including injunctions, to cease the display or disclosure of the visual depiction, and allowing for the preservation of the anonymity of the plaintiff by granting injunctive relief maintaining confidentiality through the use of a pseudonym.
